1. Acceptance of Terms

By accessing and using Kurasa ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Kurasa provides an EdTech platform that enables educators and schools to manage curriculum, track student performance, administer assessments, and facilitate communication between teachers, students, and parents.

3. User Accounts

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Billing

Subscription fees are charged monthly based on your selected plan. Additional charges apply for messages sent beyond your plan's quota at KES 1.50 per message. Payments are processed through M-PESA or credit/debit cards.

5. WhatsApp Business Policy Compliance

You agree to:

• Comply with WhatsApp Business Policy and Commerce Policy
• Obtain proper consent before messaging customers
• Not send spam or unsolicited messages
• Use only Meta-approved message templates for marketing messages
• Respect customer opt-out requests immediately

6. Acceptable Use

You may not use the Service to:

• Send illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware or malicious code
• Engage in fraudulent activities
• Harass or abuse other users

7. Data Privacy

We collect and process your data in accordance with our Privacy Policy. You retain ownership of your customer data, and we will not share it with third parties except as required by law or with your consent.

8. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

9. Intellectual Property

All content, features, and functionality of the Service are owned by Kurasa and protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

Kurasa shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

11. Termination

We may terminate or suspend your account immediately if you breach these terms. You may cancel your subscription at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
